Clear TV+ Terms and Conditions
This Agreement is made on TERMS & CONDITIONS by and between Subisu Cablenet Ltd., a
company incorporated under the laws of Nepal having company registration number
[10943/056/57] and with its registered office at Baluwatar, Kathmandu (hereinafter referred to as
"Subisu") and Customer.
Each of Subisu and Customer shall together be referred to as the "Parties" and individually as a
"Party".
NOW, THEREFORE, for and in consideration of the covenants and obligations contained herein
the parties agree as follows:
1. Subisu shall provide the Customer with the service as per the SUBSCRIBER
APPLICATION FORM's Service Details.
2. The Customer shall pay the prescribed amount including installation charge to Subisu in
advance for the purchased services.
3. Any of the STB device installed at the customer end are subject to be returned in the case
the service(s) rendered are deactivated consecutively for more than 90 days.
3.1 Company retains the right to collect the device if the service remains deactivated for the
period as mention in clause number 3.
3.2 For Clear TV+ Service, one Android Box works only for one television set. Additional Box
will be required for additional television sets and thus the Customer will have to pay for
the additional Android- Box Activation Charge.
3.3 Subisu provides 6 months' warranty on the devices. Such warranty excludes malicious
damage, damages due to voltage fluctuation and high voltage or any other such damages
which can be attributable to the Customer.
4. Subisu retains full rights to the content available on ClearTV+ and strictly prohibits users
from engaging in any unauthorized sharing, reproduction, or distribution of the content
without permission.
5. Subisu strictly prohibits any unauthorized use or infringement of copyrighted material
within the ClearTV+ platform. This means that users are not allowed to engage in activities
such as copying, distributing, displaying, or making derivative works of copyrighted
content without the necessary permissions or rights. Subisu enforces this policy to respect
intellectual property rights and ensure compliance with copyright laws. Users must refrain
from any actions that violate copyright regulations while using ClearTV+.
6. ClearTV+ users are required to uphold the confidentiality of their login credentials to
ensure the security of their ClearTV+ account. Users will be encouraged to take necessary
precautions to protect their devices and personal information.
7. ClearTV+ service is non-transferable. If ownership transfer or placement transfer of
purchased service is required, all the processes shall be followed as per the rules of Subisu.
However, the Customer is well known about the fact and agrees that Subisu shall only be
able to transfer, provide the service in its network service available areas only.
8. Phone support in case of problem at the Customer's end will be provided at all times. Field
support will be done only between 9:30 AM to 5:30 PM on office working hours.
9. ClearTv+ will add other value-added packages and subscription over the time and the
charges for those will vary accordingly. ClearTV+, at its discretion may change
subscription charges without prior notification to the Customer.
10. The Customer shall have to pay the service charge on time as per rules of Subisu. The
service to the Customer shall be discontinued, in case the Customer fails to pay the service
charge within the last date and it shall be resumed only after receiving service charge by
Subisu.
11. Payment made to Subisu shall not be refunded to the Customer in any cases except for the
refundable deposit, if any, and the settlements of such shall be done by adjusting with
Subisu's other services.
12. If the Service, having obtained-for whatever purpose, is used illegally or in unauthorized
manner by violating prevailing laws of Nepal, the Customer shall be liable and Subisu shall
be exempted from such liabilities. In the event of Subisu being held liable in any manner
whatsoever, the Customer shall keep Subisu fully indemnified of all and every cost Subisu
incurs in this regard, including reasonable attorney fees. This clause shall survive the
termination of this agreement.
13. Save as otherwise stated in this agreement, the obligation of the parties to the agreement
shall come to an end when service is terminated on the part of Subisu, and when device is
returned by customer to Subisu on the part of Customer.
14. The applicable tax and revenue to be paid against utilization of service shall be paid by the
concerned party as required under prevailing law of Nepal.
15. The agreement constitutes the entire agreement between the parties, and supersedes any
prior understanding or representation of any kind preceding the date of this agreement.
16. The agreement may be terminated by the mutual consent of the parties, or if any party
commits material breach of the agreement. In the event of termination of this agreement
by mutual consent, any amount, if refundable, shall be refunded to the Customer as per the
policy of Subisu. However, in the event of termination of this agreement owing to
Customer's breach of its obligations, no refund shall be made to the Customer.
17. If the Customer files any written complaint regarding the service charge or the service,
Subisu will carry out enquiry in this regard and the outcome of such enquiry committee
shall be acceptable to both the parties.
18. Any dispute or difference arising out of or in relation to the agreement shall be settled by
mutual consultations of the parties. If dispute cannot be settled by mutual consultation, it
shall be finally settled by court having jurisdiction thereof.
19. Terms and Conditions set forth herein below shall be applicable to the internet service only.
19.1 IPTV Service allocated to the subscriber is dynamically shared in overall.
19.2 Customers intending to operate cyber café or information centers shall also abide by the
following terms and conditions:
a. The proprietor of cyber café or information center shall register its business with the
concerned government authorities before operation of cyber café or information Centre, if
there is any prerequisite to register the business with such authorities.
b. The proprietor of cyber café or information Centre shall have to obtain Permanent Account
Number (PAN) from the concerned tax office before its operation.
c. The Proprietor of cyber café or information Centre shall have to give invoice to its customer
by making bill after receiving amount for service charge.
d. If the place of business is relocated or the proprietor of cyber café or information Centre is
changed, the proprietor shall have to give all the information to concerned bodies
(Registering authority).
e. Information for consciousness including disciplinary rules to be maintained by is customers
shall be kept in the Centre by the proprietor of cyber café or information Centre.
f. The cyber café or information Centre shall provide information, if any of its customer
desires to understand about the services occupying by the Customer.
g. The cyber café or information Centre shall provide services by checking identification
card of its customers (Citizenship, Driving License, and Student Identity Card) and the
logbook of the services provided should be maintained.
h. The cyber café or information Centre shall provide the logbook, if such book is demanded
by security agency and in other situation that details shall have to be kept secret.
i. The tax and other charges to be paid by the cyber café or information centre shall be as
prescribed by Government of Nepal in time to time.
j. The cyber café or information centre shall have to keep the rate of service charge to be
obtained from its customers by making visible to all.
k. The cyber café or information centre shall have to keep internet speed (Bandwidth)
obtained from ISP and number of computers sharing such internet speed (Bandwidth) by
mankind visible to all.
l. If any dispute rises between the cyber café or information centre and its customer regarding
the service, Cyber Cafe or the information centre will be responsible to maintain QOS to
its customer and Subisu will not be liable in anyways.
m. Though the Internet/Email service has been obtained for whatever purpose, no one shall be
allowed to perform the activities prohibited by prevailing laws and only the service
provided by the license holder shall be allowed to use.
n. The cyber café or information centre shall have the duty to pursue the direction issued by
the service provider in the time to time.
19.3All the Internet rates are based on Subisu fair uses policy ("Subisu FUP")
20. Subisu Fair Usage Policy (SFUP) will be applicable
